New restrictions upon gaming machine advertising
New gaming machine advertising restrictions will come into effect from 1 July 2010. The new restrictions include a broader definition of what is meant by gaming machine advertising and a threefold increase in penalties for a breach of the restrictions.
Gaming machine advertising is now defined as any form of advertising that contains any information, term, expression, symbol or other thing associated with gaming machines. It does not include anything about, or the advertisement of services relating to, problem gambling, or technical information relating to the operation of a gaming machine.
Information, or a term, expression, symbol or other thing is taken to be associated with gaming machines if a reasonable person with ordinary knowledge who is a resident of Victoria would consider it to be associated with gaming machines.
These new restrictions upon gaming machine advertising apply to venue operators, to gaming operators and to the casino operator, or to anybody publishing advertising on their behalf.
